Recently we've looked into upgrading our harvesting equipment and trading off our older 2388 for new 7120. At the moment we are a few hundred acres of totally justifying the outfit on our own. One thought was to join a crew with it and pull in the small difference needed until the appropriate land opened back up around our farms. My question is if there are crews out there that hire this sort of work/situation (machine and operator), and if there is where can I find them? I am 28 years old. Lived on a family owned very large swine farm in south central Wisconsin all my life. During high school and the year after I worked at Midstate Power and Equipment. (A large John Deere dealer) From there I attended Universal Technical Institute in Glendale Heights, IL where I studied automotive diesel and industrial equipment repair and recieved ase certifications. We run just short of 2000 acres in corn, soybeans, and wheat which I have been very involved with during planting and harvest seasons taking my vacation from being an ase certified automotive tech for 6 years which I gave up before early last spring to farm full time. I am also on the local fire department in Reeseville, WI. I have driven many many different types of tractors, mostly operated deere combines and any tractor they've built, we run greenstar 2600 display with with autotrak guidance very computer oriented and trucks such as but not limited to Kenworth isc 330 with 3000 evs trans, Int. 9200i with fuller 10 speed and Wilson 42 foot hopper bottom, Int. DT466 with Eaton 13 speed, GMC Top Kick with high/low split shift and others. I am also very mechanically inclined with fabricating or repairing and know what it takes to get the job done and get the job done right.

The Non-Resident CDL bill was voted on and passed the Senate unanimously today (3-17-09), along with the emergency clause that will put it into effect as soon as it is signed by the Governor. I hope everything will be put into place by mid April, I will have to check on this! I was in bismarck last Friday and testified at the senate appropriations committee meeting. I'm glad I went, I think they had a better understanding of the problems we encounter every spring with the Social Security number issue. Good morning to my friends of The Cablka's see you all up and around Lamar and west farm CO 2009 harvest ... season .. I am planning to harvest up and around the south east part of CO ... I am booked up for the state their but I even may wan't to talk with you all on a deal on trucks ... I may come by and stop on by the shop in Lawton so I may need a few hopers for a stand by I have 2 hopers and 5 machines and a 1200 bushel cart on hand and field ready for the 2009 season .... ask your son if Denis Backhand would like to help
my range from a customer is 1800 acres and I have 4 other s to run pick up real's so I am looking at around 5500 Acres charging $22 per acre and 22 cents per bushel to haul if over 20 B.P.A you and I know what Barley does and bring and what the line is and how long of time to dump and return to field .... you got my number and or ILL stop on by in a few days from now when I return from TX to Oklahoma

What's New

On March 17, 2009,The Department published a Notice of Proposed Suspension of the H-2A Final Rule, published December 18, 2008. The Department is accepting comments on the Notice of Proposed Suspension. To see the Notice,

New Prevailing Wage Form: In conjunction with the regulations going into effect on January 18, 2009 for the H-2B program, the Department has created and received approval from OMB for a new form to collect the necessary information from employers in order to provide a prevailing wage so that employers may begin the recruitment process. Employers must begin using the Form ETA-9141 for wage requests for H-2B work that is to commence on or after October 1, 2009. For instructions on how to complete the form and appendices see the instructions.


For LCA System:
WARNING: Effective upon the enactment of HR 1, the American Recovery and Reinvestment Act of 2009, pursuant to section 1611(b), Div. A, it shall be unlawful for any recipient of funding under title I of the Emergency Economic Stabilization Act of 2008 (Public Law 110-343) or section 13 of the Federal Reserve Act (12 U.S.C. 342 et seq.) to hire any nonimmigrant described in section 101(a)(15)(h)(i)(b) of the Immigration and Nationality Act (8 U.S.C. 1101(a)(15)(h)(i)(b)) for new employment unless the recipient is in compliance with the requirements for an H-1B dependent employer (as defined in section 212(n)(3) (8 U.S.C. 1182(n)(3))), except that the second sentence of section 212(n)(1)(E)(ii) of such Act shall not apply. Employers who are recipients of such funding may not file Labor Condition Applications (LCAs) for new employment unless they complete the actions and make the attestations required of dependent employers. *Until further notice, for those companies that are not dependent H-1B employers but are subject to this provision, please check Box “B” in Section F-1.1 of the ETA-9035 in order to demonstrate compliance as required. It is recommended that such employers retain documentation regarding their status.*

Briefings on using redesigned labor certification forms.
On February 4 and 9, 2009, the Department of Labor held public briefings in San Diego and Baltimore, respectively, to educate stakeholders, program users, and other interested members of the public on using the reengineered application form 9089 used in the PERM program and form 9035 Labor Condition Application used in the H-1B/H-1B1/E-3 programs. The U.S. Department of Labor's Employment and Training Administration (ETA) today announced the proposed suspension for nine months of a final rule implementing changes to the H-2A program, which allows U.S. agricultural businesses to employ foreign workers in temporary or seasonal agricultural jobs. The department's proposed action is open for public comment for 10 days. "Because many stakeholders have raised concerns about the H-2A regulations, this proposed suspension is the prudent and responsible action to take," said Secretary of labor Hilda L Solis. "Suspending the rule would allow the department to review and reconsider the regulation, while minimizing disruption to state workforce agencies, employers and workers." The proposed suspension of the final rule will appear in the Federal Register on March 17. The final rule appeared in the Federal Register on Dec. 18, 2008, and took effect on Jan. 17, 2009. The H-2A nonimmigrant program is designed to provide agricultural businesses with short-term foreign agricultural labor when there are not enough domestic workers. Receiving an H-2A labor certification is the first step in the employment-based immigration process to work on a farm. In 2008, the department granted North Carolina, Georgia and Florida the largest numbers of H-2A labor certifications. The Labor Department's Office of Foreign Labor Certification will continue to accept and process H-2A applications during the proposed suspension period. Any final action on today's proposed suspension will appear in a future Federal Register notice.

this is in response to March 1st posting by Anonymous.

Deductions are only made for W4 employees. If Double DCF didn't have any deductions, then my guess is that he was a 1099 employee, which means that he was contract labor and there aren't any deductions made. Deadlines for W2 mailings from companies was nearly 2 months ago as was the deadline for 1099's. Sounds like maybe the harvester was playing by the rules and good ole double dcf just can't make sense of it all. Maybe if people who don't understand taxes would quit giving advice on taxes then everyone wouldn't automatically think that a company is trying to cheat... fyi, companies write off payroll... it is in their best interest to mail 1099's and W2's, and it is the law.

i would encourage you to do some more homework before you give out advice on tax situations that you don't understand.

1 more note on the multiple checks... Being a harvester I have many of times collected paychecks for jobs completed from farmers who have paid with multiple checks. This is going to be complicated for you tax amateurs out there. They do that to manage their taxes and deductions. They also do it to manage government subsidy programs. When an employee is a contract laborer, sometimes companies will pay them from subsidiaries, or other entities to MANAGE THEIR TAXES... DCF if you run into these situations and don't want to collect multiple paychecks send me your customer list if you have one. they all cash the same.

the cpa as to many times referenced = certified public accountant. There is no such thing as THE CPA. There are more cpa's then there are attorneys. So, Double DCF why don't you contact A CPA, i.e H&R block. Tell them you didn't have any taxes withheld from your paycheck, and I will bet you 25 combines that he will say; "ok, do you haver your 1099"

FD, you may want to read about contract labor in the home state of your employer. If you are contract labor in agriculture in some midwest states, you are responsible after the end of the year for your own taxes. How much you would have to pay would depend on how much each check was written for per week I believe. But as a seasonal worker, unlike your last job in construction, this is how MANY workers are paid. I would agree that you should contact your employer for a better understanding, but if they have been in the agriculture industry for many years, chances are they have hired many people through the summers for farm work and they probably have an understanding on how they can pay their employees and follow the law.

Hello, my name is Jason Hendricks, I am 33 and have a perfect driving record. I am currently helping family prepare for spring planting, in Missouri and Minnesota/Iowa/South Dakota areas. Harvesting is in my blood. I was raised on and around the farm, and continue to make this my lifestyle. I would like to go back on harvest. I carry a Class A CDL, with hazmat, and have OTR experience hauling wide and oversize loads, commodities and livestock. I went on the harvest run for several years after high school. I have OSHA certifications, computer skills, welding and ag mechanics certification. I am not as up to date on newer equipment as I am on JD 9600's and 2388's, Gleaner R72's, but will learn. I have been working for IBEW for the last 10 years as an equipment operator and safety forman. I am tired of layoffs, and miss agriculture full time. Pam, I certainly agree with all you have to say! We couldn't have such an amazing trade show without each and every one of them!!! The Misener family gave 150% - No, 250% - to everything they did behind the scenes. Ron and Kristy should be PROUD! And TO YOU, Pam!! Without all the work you had done before we all got there on Monday and Tuesday, this wouldn't have been as successful as it was. I've helped enough behind the scenes to see all the work that's involved! We are a team! Without any of us and the God given talents that's put into this organization, it just wouldn't be what it is! I know you're already in the beginning stages of the 2010 convention - that's awesome!
Thanks goes out to the Kansas ladies and their abilities in decorating and pulling the ladies luncheon together! Thanks goes out to the Scholarship committee and the number of hours they put into that program because of the belief they have in our kids! Thanks to our major sponsors because without them, none of this would be possible either. It takes a lot from a lot of people to make this work and it definitely worked this year!

For those of you who currently harvest through kansas, colorado, nebraska, etc, how hard would it be for a new custom harvesting outfit with two combines, cart, and trucks to find work? Also, how do you go about advertising your service in the region, do you put up flyers? Go yard to yard? Contact elevators looking for farmers that might be interested?Or do you simply park your equipment in town hoping to catch someones eye? What are the odds of finding 4000-5000 total acres (not on a single job of course) over a month to month and a half of cutting through the area?

So your saying I need to contact the CPA ..? does it make a difference if I was in a another State or should I contact CPA of Nebraska sent's the company is based there and has a address and phone numbers and I have 4 different check account number that they wrote me checks on just to drive a combine's cents they could not afford to write me just one check on 10--10-08 and they was always late on given me any pay checks check number 1067 / 1346 /4051 all 3 checks was given to me at once for the same job for my pay as a employee per month of 1800 A month . ?? and or should I have to contact my loco
CPA officer the state I am from now and yes they are a one of a new members here on the USCHI that is a very New here last year was their first year in the harvesting other farmer crops on their own and hire me as I was looking for a job on a crew as a Employee

Maybe you could contact the cpa and find out what is the correct way to have handled the withdrawals. Then, contact the harvester and tell him you want it done right or you'll have to contact authorities. We ALL have to abide by rules and that harvester should have to, as well. It was just 2008, he shouldn't be too far from meeting deadlines, etc.
